Terms of Use

1. Who can use SoworeNow

• You must be 18 years of age or older. Nigerian electoral participation begins at 18 and we apply the same threshold here.
• You must be able to enter a binding contract in your jurisdiction.
• You may not use the Service if you are barred from doing so under any applicable law (e.g. sanctions lists).

If we learn that an account has been created in breach of these requirements, we will close it.

2. Your account

2.1 Account creation

You agree to provide accurate, current and complete information when you sign up, and to keep it up to date in Profile → Edit profile.

2.2 Verification

Several features (creating community posts, donating in some campaigns) require your account to be verified. Verification happens through either:

• An email OTP we send you, or
• Linking a confirmed AAC (African Action Congress) membership.

You only need to complete one of those once.

2.3 Account security

You are responsible for any activity that happens through your account. Keep your password private. If you suspect unauthorised access, change your password and contact [email protected] at once.

2.4 One account per person

You may keep only one active SoworeNow account. We reserve the right to merge or remove duplicates.

2.5 Closing your account

You may close your account at any time from Profile → Sign out → Delete account. Closure does not relieve you of obligations that accrued before closure (e.g. completed donations, content reports already in our queue).

3. The Service

We give you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to install and use SoworeNow on devices you control, for personal, non-commercial use, as long as you comply with these Terms.

The Service is provided as-is and we may add, change, or remove features at any time. We will give reasonable notice for material changes.

4. Community guidelines

When you post, comment, react, message or otherwise contribute content to the Service, you agree to follow these rules:

1. Stay on-topic. Community posts are for the movement, the campaign and political engagement in Nigeria.
2. No harassment, abuse, hate speech or doxxing. Personal attacks, threats, ethnic / religious / gender-based slurs, sharing someone else’s personal information without consent — all prohibited.
3. Don’t spread misinformation. Cite sources for factual claims.
4. No spam, scams or commercial promotion you don’t own.
5. Respect privacy. Don’t post someone else’s photo or personal details without their consent.
6. No incitement to violence, voter intimidation, or election-day misconduct. Nigerian election law applies here.
7. No illegal content — child sexual abuse material, terrorism, identity theft, fraud, etc.
8. No impersonation of public figures, coordinators or other supporters.

Violations may result in content removal, posting restriction, suspension or permanent account termination at our sole discretion.

5. Your content

5.1 Ownership

You retain ownership of the photos, videos, posts, comments and other content (“User Content”) you submit.

5.2 Licence to us

By posting User Content, you grant SoworeNow a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, adapt (for thumbnailing / resizing / format conversion), translate (for in-app language settings), distribute and display the User Content solely for the purpose of operating, promoting and improving the Service. We will not use your User Content in paid advertising without separately asking you.

This licence ends when you delete the User Content or your account, except:

• For content that has been shared by other users (their cached copies persist).
• For content under active moderation review.

5.3 Responsibility

You represent and warrant that you own or have all rights to the content you submit, and that posting it does not infringe anyone’s rights or break any law. You are solely responsible for your User Content.

5.4 We may remove content

We may, but are not obligated to, review, moderate, or remove any User Content for any reason consistent with these Terms or our Privacy Policy. We are not a publisher of User Content under Nigerian or international law.

5.5 Reporting content

Any user can report a post, comment or account from the in-app Report action. Reports are reviewed by a human admin. False or abusive reporting is itself a violation of these Terms.

6. Verification, AAC link and impersonation

• The verified check that appears next to a name means the account has confirmed an email; it is not an endorsement.
• The Coordinator badge means the user has been granted the coordinator role by an administrator.
• Linking your AAC membership confirms with AAC’s systems that the email or member ID you provided is a real AAC member. It does not share your AAC password with us.
• You may not impersonate Omoyele Sowore, any AAC office-holder, any coordinator, journalist, official or other identifiable person in your profile, username or content.

7. Donations and payments

7.1 Processors

Donations and merchandise payments are processed by Paystack and Flutterwave. By donating you also agree to the processor’s terms. SoworeNow does not store your card number, CVV or bank credentials.

7.2 Donations are voluntary

All donations are voluntary and made to support the Take It Back Movement and its campaigns. They are not tax-deductible unless the campaign page explicitly says so.

7.3 Refunds

Donations are generally non-refundable. Where a donation was made in error, double-charged, or made fraudulently with a stolen payment method, contact [email protected] within 14 days and we will investigate. Refunds are at our sole discretion and follow the processor’s reversal window (Paystack: typically up to 90 days; Flutterwave: typically up to 180 days).

7.4 In-kind pledges

In-kind pledges (goods or services) become the property of the movement on delivery. We may publish anonymised totals.

7.5 Fraud

We may pause, cancel or refuse a donation we reasonably believe to be fraudulent, money-laundered, or originating from a sanctioned party. We report what we are required to report to the EFCC, NFIU and other relevant bodies.

8. Volunteering

When you volunteer through the app, you confirm that:

• You volunteer of your own free will and without expectation of payment unless the opportunity explicitly says so.
• You will follow the coordinator’s lawful directions during the activity.
• You take responsibility for your own safety. SoworeNow is not liable for incidents at rallies or volunteer events.

The full app’s My Volunteering dashboard shows the status of your requests.

8A. Points and rewards

SoworeNow includes a points & rank programme. You can earn points for taking part (for example opening the app, donating, volunteering, joining a live, redeeming an event-attendance code, referring someone who signs up, or submitting evidence of an off-app activity for review), reach ranks / levels, and spend points on rewards we make available from time to time (for example data or airtime credit, or movement merchandise).

1. No monetary value. Points and rewards have no cash value, are not money, property or a stored-value instrument, are non-transferable, and cannot be sold, exchanged for cash, or combined across accounts.
2. We may change the programme. We may add, change, suspend or discontinue the programme, the actions that earn points, point values, ranks, available rewards and redemption rules at any time, and we may expire points — with reasonable notice where practicable. Rewards are subject to availability.
3. Earning and spending are server-decided. Points are awarded and spent by us based on server-verified actions; the balance shown in the app is our record. Claims and support redemptions are reviewed by an admin before points are awarded or a reward is fulfilled, and approval is at our discretion.
4. Reward fulfilment. Where you redeem points for help such as data or airtime credit, you authorise us to use the phone number or contact you supply to arrange and deliver it. Fulfilment is handled by the movement at its discretion and may take place outside the app — see the Privacy Policy §2.12.
5. No abuse. You may not manipulate the programme — including through multiple or fake accounts, self-referrals, bots or scripts, fabricated or misleading claim evidence, or any scheme to obtain points or rewards you did not genuinely earn. We may withhold, reverse or void points and rewards, and suspend or terminate accounts, for actual or suspected abuse.
6. Forfeiture. Unredeemed points and unfulfilled rewards are forfeited, with no compensation, when your account is closed, terminated or deleted, or when the programme ends.
7. Not a promise or inducement. The programme rewards participation in the movement. It is not employment, payment for volunteering (which remains voluntary under §8), a lottery or game of chance, or an inducement to vote.

9. Messaging

Private one-to-one and group chats are visible only to participants. We do not read message bodies. Admins may review messages only when a user files a moderation report against a specific message.

You agree not to use messaging for harassment, spam, illegal solicitation, or to send anyone material covered by §4.

10. App Clip

The SoworeNow App Clip is a lightweight, anonymous read-only version of the Service. You can use it without creating an account, but it is intentionally limited: most actions (post, react, comment, RSVP, donate, volunteer, AAC link) require installing the full app. These Terms apply to your use of the App Clip insofar as they are applicable.

11. Acceptable use

You may not, in connection with the Service:

• Reverse-engineer, decompile, copy or scrape the Service except as permitted by Nigerian law.
• Use bots or automated tools to create accounts, post content, send messages, or scrape the public feed.
• Probe, attack, or test the security of the Service without our written authorisation. (Responsible disclosure: see §17.)
• Attempt to access another user’s account.
• Resell, rent or sublicense access to the Service.
• Submit content known to be false, misleading, harmful or illegal.
• Use the Service in any way that materially burdens or interferes with our infrastructure.

Violations may result in account suspension and, where appropriate, civil or criminal referral.

12. Intellectual property

The Service, including the SoworeNow name, logo, the Anton-styled wordmark, the Take It Back Movement marks, all software, designs, text, graphics, AI-generated summaries, and the underlying API, are the property of Take It Back Movement (or its licensors) and are protected by Nigerian and international copyright, trademark and trade-secret laws.

We grant you no licence to use any of those marks for your own purposes.

13. Third-party services

The Service integrates with third parties (see Privacy Policy §7). We are not responsible for those services and their availability / correctness is not something we can guarantee. When you use a third-party feature (e.g. a Paystack checkout page, an external news source, X cross-posting), the third party’s terms also apply.

14. AI features

Today’s Briefing, AI summaries, AI-driven language translation and the in-app assistant are generated by third-party large-language models (OpenAI or Google Gemini). AI output:

• Is generated by a machine and may be wrong.
• Should not be relied upon for medical, legal, financial or other professional advice.
• Is summarised from public sources we believe to be accurate, but we do not guarantee the underlying facts.

Always verify important information through primary sources.

15. Disclaimers

To the maximum extent permitted by Nigerian law:

• The Service is provided “as is” and “as available”.
• We make no warranties of merchantability, fitness for a particular purpose, accuracy of content, or non-infringement.
• We do not warrant that the Service will be uninterrupted, timely, secure or error-free.
• Outages, data loss, message-delivery failures or payment-processor downtime may occur. We will work to restore the Service promptly but we do not guarantee any uptime SLA.

16. Limitation of liability

To the maximum extent permitted by Nigerian law:

• We are not liable for indirect, incidental, consequential, special, exemplary or punitive damages, including loss of profits, loss of data, loss of reputation, or business interruption, even if we have been advised of the possibility.
• Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) ₦10,000. (Most users pay us nothing.)

Some jurisdictions do not allow some of these limitations. Where a limitation is not enforceable in your jurisdiction, it is replaced by the maximum protection allowed there.

17. Indemnification

You agree to defend, indemnify and hold harmless SoworeNow, the Take It Back Movement, its officers, employees and contractors from any third-party claim arising out of:

• Your User Content.
• Your breach of these Terms.
• Your violation of any law or third-party right.
• Your use of the Service to commit a tort or crime.

18. Security disclosure

If you discover a security vulnerability, please tell us privately at [email protected] before disclosing it publicly. We will respond within 5 working days and credit reporters in a “Hall of Fame” page where you wish to be credited.

19. Termination

We may suspend or terminate your account, at any time, if we reasonably believe you have breached these Terms or the Community guidelines, or if required by law. Where possible, we will notify you first and give an opportunity to remedy.

Termination does not affect:

• Donations already received.
• Content already shared by other users.
• Provisions of these Terms that by their nature survive termination (e.g. §§5, 12, 15, 16, 17, 20, 21).

20. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles.

21. Dispute resolution

21.1 Informal resolution

Before filing a claim, contact us at [email protected]. We will try to resolve the dispute informally within 30 days.

21.2 Mediation / arbitration

If informal resolution fails, the parties will first attempt mediation under the Lagos Court of Arbitration / Lagos Multi-Door Courthouse rules. If mediation fails, the dispute will be settled by binding arbitration in Lagos under the Arbitration and Mediation Act 2023 (Nigeria).

21.3 Class action waiver

To the extent permitted by Nigerian law, all disputes will be resolved on an individual basis. No class, collective or representative action is permitted.

21.4 Courts

Where a dispute is not arbitrable, the Federal High Court of Nigeria, Lagos Judicial Division has exclusive jurisdiction.

22. Changes to these Terms

We may update these Terms. Material changes are notified by email and in-app at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
